BAIL HEARINGS FOR ICE DETAINEES TO RESUME TOMORROW

 WHAT:

Bail hearings for ICE detainees held at the Wyatt Detention Center will resume tomorrow before District Judge Mary McElroy. There are currently 33 ICE detainees being held there, and 4 hearings are scheduled for tomorrow.

 The hearings are the result of a class action lawsuit, filed in May 2020, seeking urgent relief for immigration detainees held at Wyatt who face the spread of COVID-19 at the facility. The suit was filed when the count of detainees at the facility infected with COVID-19 more than doubled in three days. To date, the suit has secured the conditional release of more than two dozen detainees, and ICE officials have administratively released numerous others without the necessity of a formal court hearing.

 Earlier this year, ICE filed a motion to dismiss the case, claiming that COVID-19 conditions at the facility had changed substantially since last year. On March 23, 2021, Judge McElroy declined to dismiss the case, and said that, for the time being, the Court would continue granting hearings to any detainee requesting one.
