The following missive was sent by the plaintiffs, the parents of children that are the target of the School Mask Mandate, to Rhode Island Senate President Ruggerio & Rhode Island Speaker Shekarchi. As noted by the litigants, “Judge Lanphear ruled strongly in our favor on the issue of irreparable harm … a rebuke of RIDOH’s position that masking children for up to 8 hours per day causes them no harm.”

The Court finds that these children are suffering and reasonably infers that children across the state are suffering with the mask mandate.
This Court heard credible testimony from multiple Plaintiffs that their children were suffering adverse effects from the requirement that they wear masks throughout the school day. These adverse effects include physical and emotional discomfort and interference with the children’s ability to interact with teachers and peers.
Regardless of the uncertainty surrounding potential long-term medical problems resulting from mask wearing, this Court finds that Plaintiffs’ testimony regarding the ongoing impact of the mask mandate on their children suffices to establish a finding of irreparable harm.
(Dr. McDonald) admitted he had not done a “cost-benefit analysis” when considering masking.
In light of these deeply troubling findings, the General Assembly no longer has the luxury of watching from the sidelines. Your direct and immediate action on this issue is required. There can be no delays. There can be no more excuses..
As we begin the 2022 election cycle, parents and grandparents across the state are watching to see how elected officials respond to this situation. We will remember what you say about the irreparable harm being inflicted on our children and … we will remember what you do not say. We will remember what you do to alleviate their suffering and … we will remember what you do not do.
